Sexual assault of a child is defined by Texas Penal Code Sec. 22.011 and involves any sexual activity with a person under the age of 17. The statute is gender-neutral and includes vaginal intercourse and other sex acts. Consent is irrelevant when a child is involved because a child is legally incapable of consenting to sex.
A person can be convicted of sexual assault of a child in Texas if he, or she, intentionally or knowingly:
Sexual assault of an adult or child is a second-degree felony. Penalties range between two and 20 years in prison if convicted, with maximum fines of $10,000. You will also need to register as a sex offender for life.
OTHER CONSEQUENCES In addition to the prison terms and fines one can face when convicted, you may be required to register as a sex offender. This means you will be tracked for the rest of your life.
These are highly sensitive, fact-driven criminal cases with enormous stakes. They take tremendous skill, vast experience, dogged tenacity, and compassion.
The prosecutor needs to prove your guilt beyond a reasonable doubt.
